Terms of Use Agreement

This is a legal agreement (the "Agreement") between you and Diaper-BOIS.com, hereby referred to as (the "Site").  By using the Site, you agree to be bound by these Terms of Use.  If you do not agree to these terms and conditions, you may not use the Site, and should not proceed to register.  The terms are subject to change at any time, effective upon notice to you.

User Agreement

This Agreement describes your agreement with Diaper-BOIS.com with respect to your use of the services offered.  You must agree to abide by the terms and conditions in this Agreement in order to become a Member of the Site.  As used in this Agreement, "we" and "us" refers to Diaper-BOIS.com.

Eligibility for Use of Service

You must be at least 18 years of age to register as a Member of the Site.  We may require that you provide information to indicate that you are at least 18 years of age.  By using the Site, you warrant that you gave the right, authority and capacity to enter into this Agreement and to abide by all of the terms and conditions thereof.

Right to Use of Service

Your right to use the service is subject to any limitations, conditions and restrictions established by us.  We reserve the right to alter, suspend or discontinue any aspect of the service at any time.  As well, we reserve the right to remove any messages or materials that we deem to be offensive (i.e. profiles, postings, messages and photos).  You are responsible for the content of the profiles, postings, messages and photos that you may upload to the Site.  We may discontinue or change the service or it's availability to you at any time, and you may stop using the Site at any time.

Online Conduct

You agree to use the service in accordance with the following Online Conduct.  We reserve the right to investigate and take appropriate legal action against anyone who violates the conduct laid forth.  This includes removing the offending communication and terminating the membership of such violators.

-You will keep all information provided to you through the Site as private and confidential, and will not give the information to anyone without permission from the person who provided it to you.

-You will not use the Site to engage in harassment or offensive behaviour of any form.  This includes, but is not limited to, the posting of communications, pictures or recordings which contain defamatory, malicious, abusive or libelous statements as well as racist, pornographic or obscence language.

-You will not use the Site to infringe on the personal rights, property rights or privacy rights of any person.

-You will not use the Site to engage in advertising of any sort.  The Site is for personal use of Members only.  Organizations, companies and businesses may not become Members.  Illegal and/or unauthorized uses of the Site will be investigated, and appropriate legal action will be taken.  You will also not transmit or forward chain letters and/or junk e-mails to other Members or employees of the Site.

-You are responsible for your interactions with other Members on the Site.  We reserve the right, but have no obligation to monitor and/or mediate disputes between you and other Members on the Site.

-You will not post or upload any viruses, or cause harm in any way to the Site and/or other Members.

-You will not modify, adapt, sublicense, translate, decipher or disassemble any portion of the Site or services offered.  We own and retain all proprietary rights to the Site and services.  You will not post, distribute or reproduce any copyrighted material without obtaining prior written consent of such rights.

-We may review and delete any content or messages that we deem to be offensive, illegal or that might violate the rights of other Members.

-You may not include in your Profile any telephone numbers, street addresses, last names or e-mail addresses.  We reserve the right to remove any such content from your Profile.

Membership Categories

There are two different categories of users on the Site; "Free Members" and "Premium Members".  Free Members are allowed to access a subset of the site and are not allowed access to all of the features that Premium Members are allowed access to.  Free Members are not charged for the features they can access.  Premium Members are provided with access to additional features of the Site that are not available to Free Members.  They are not charged for the features that are free to Free Members.  Certain additional features of the Site are made available to Premium Members free of charge.  As well, certain features of the Site are "paid features", for which a Premium Member is charged.

Fees and Payments

Subscription fees for Premium services are charged to your credit card when you successfully submit your order and a billing period begins. All subscriptions are automatically renewed and your credit card rebilled at the end of each term until cancelled.

Please note: All subscription payments are nonrefundable.

For example, if you subscribe to the monthly plan, the subscription will renew and your credit card will be billed again at the start of the next monthly period, unless you cancel. You must cancel before the close of the current billing period to avoid subsequent charges. We do not offer a "one-time" or fixed-term subscription.

If you cancel your subscription before the end of your current billing period, the cancellation will take effect at the end of that billing period. You will not be billed for any subsequent term. After canceling, you will continue to have access to the Premium services features until the end of your current billing period.

Privacy and Use of Information

By accepting the terms of this Agreement, you have also agreed to our Privacy Policy.  You agree that:

1.  We cannot ensure the security and privacy of information you provide through the Internet and your personal e-mail messages.  You release us from any and all liability in connection with the use of such information by other parties.

2.  We are not responsible for, and cannot control, the use of any information, which you provide to them, and you should use your own discretion in selecting the personal information you provide to others through the Site.

3.  We cannot assume any responsibility for the content of messages sent by other users of the Site, and you release us from any and all liability in connection with such communications.  We cannot guarantee, and assume no responsibility for verifying the accuracy of the information provided by other users.

4.  You may not use the Site for any unlawful purpose.  We may refuse to grant you a nickname that impersonates someone else, or is protected by trademark , or is vulgar or otherwise offensive, as decided by us.

Proprietary Information

The Site contain information which is owned by us and our partners.  We have full copyright protection on the Site.  You agree not to modify, copy or distribute any such information in any manner whatsoever without obtaining prior written consent of the owner of such information.

External Links

Occasionally, the Sites may contain links to other sites and resources ("External Sites").  You agree that we are not responsible for, and have no liability as a result of, the availibility of External Sites or their contents.  It is suggested that you review the terms of use and privacy statements of such External Sites prior to your use of them

Governing Law

If a dispute occurs about or involving the Site, you agree that it will be governed by the laws of the Province of Ontario, and will be subject to federal courts applicable within the province.

Indemnity

You agree to indemnify us, our subsidiaries, directors, employees, affiliates, officers and agents from any loss or damages, including attorney's fees which we may suffer from your activities on or use of the Site.

We do not represent or endorse the accuracy or reliability of any advice, opinion, statement or other information displayed or distributed through the Site.

We reserve the right to modify this Agreement at any time, upon notification to you.  Notification of changes will be posted on the Sites, or sent via e-mail.  If you do not agree to any modifications, you should terminate your use of the Site.
